Daniel’s practice focuses on advising acute, long term care and post-acute care providers and their ancillary service businesses on regulatory business issues, transactional matters and advocacy matters.
Daniel’s specialty areas include long-term care ancillary services; telehealth and remote patient monitoring; urgent care centers; home health and hospice; physical therapy, occupational therapy and speech language pathology; behavioral health, including IDD, home- and community- based community services, substance abuse disorder treatment centers, social work, psychology and mental health counseling; physician organizations and MSOs; dental practices and DSOs; ambulatory surgery centers and other ambulatory care facilities; retail, institutional and specialty pharmacy; and group purchasing organizations for health benefits.
Daniel regularly counsels clients on regulatory issues, compliance, licensure, HIPAA, state privacy laws, certification, Medicare and Medicaid reimbursement, telemedicine and telehealth considerations and in the area of fraud and abuse, including, federal and state anti-kickback laws, physician self-referral laws, and the False Claims Act.

Represented Asana Hospice, a national hospice provider, as healthcare regulatory counsel, in its acquisition by Amedisys, Inc.
Represented a primary care group in the business formation of a management support organization to physician practices in New York and other states with a focus on physician extenders and telemedicine in long term care facilities and to enhance EBITDA for a future capital event. Handled all aspects of structuring, diligence and execution of all arrangements and ongoing post-closing integration and regulatory matters.

Representing a telehealth physician practice as healthcare regulatory and transactional counsel in all legal matters with a focus in New York and New Jersey, such as in connection with the formation of a management services organization and corresponding medical group, ongoing regulatory guidance in connection with telehealth matters and remote patient monitoring arrangements, and drafting services agreements, employment agreements and corporate formation documentation.

Representing a cancer center as healthcare regulatory and transactional counsel in various matters, including the business formation of a physician practice providing cancer and hematology professional services, advising in connection with employment agreements, service agreements, managed care contracting, and other ongoing regulatory matters.
Served as healthcare regulatory counsel for a New York-based private equity firm in its acquisition of a nationally recognized behavioral health provider specializing in clinical, educational and residential services for children and adults.
Serving as regulatory and transactional counsel to a New Jersey-based private equity firm across its diverse healthcare portfolio, including urgent care, pharmacy infusion, home health, hospice, long-term care and related ancillary businesses.

Advised on the restructuring and merger of four New York–licensed home care services agencies and Consumer Directed Personal Assistance Programs, including regulatory analysis, tax structuring, estate planning and related contractual arrangements, as well as obtaining required Department of Health approvals.
Representing a multispecialty physician services organization in transactional and regulatory matters related to physician practice arrangements in long-term care facilities, including advising on vendor relationships, contracts, telehealth and chronic care monitoring arrangements, and conduct internal compliance audits to assess company operations.
Advising a hospice platform in its multistate growth strategy, including the formation of four new hospice entities and provide ongoing counsel on acquisitions, joint ventures, service contracts, medical director arrangements, clinical consent issues and regulatory considerations.
